Re: Your application to the Commission

We refer to your faxed letters dated 17 and 18 February 2003. You have raised a number of points:

Waiver of legal privilege. The Commission's usual practice is to make it's own enquiries into such matters. You have suggested that you would prefer to write to your former barristers yourself and forward their responses to the Commission. The Commission is happy for you to take this course if you wish but such intervention would obviously have some bearing on the weight that can be attached to that evidence.

Your documents. The Commission notes that you have a large quantity of documents, the Commission would like to make arrangements to view these. It would be of assistance if you could send us an inventory of the documents in your possession and explain why they are relevant to your application.

Disclosure. You have requested access to the documents that the Commission has obtained in the course of its investigation. Section 23 of the Criminal Appeal Act 1995 prohibits the disclosure of information except where such information is disclosed in the Statement of Reasons. The Commission will also disclose any information it holds which will which will enable an applicant to make his best case. The Commission is satisfied that it holds no papers, which would assist you in your application. If you feel that the Commission has misunderstood it's duty of disclosure the best way to challenge this is in the High Court by means of Judicial Review.

New Evidence. With reference to the possible new evidence from the new president of the Republic of Cyprus and that regarding the possible prosecution of Dr Graham S Pearson. The Commission is not prepared to delay making its final decision. If further evidence becomes available in the future you are free to make a fresh application to the Commission.

With regard to the points that you have raised these will be dealt with as further representations. A number of the documents you refer to we have not got access to, in particular the "AD" and "RH" tapes. We would be grateful if you could send copies of these tapes or transcripts of the same.

We note that you intend to raise the "intent" element of Count 2 we look forward to receiving your submissions on this point as soon as possible.

Please raise any further points and submissions in connection with your application in writing as soon as possible and send any supporting documentation.
